We will not send promotional e-mail to consumers except unless they have first given their consent. Information provided such as credit card details, names, address's and frequent flyer memberships shall only be used by us in order to improve the efficiency of the service we provide you and shall not be passed on to a third party for reasons other than completing the transaction and agreement we enter in with you by using the Packyourbags.com services. All transactions over the internet are made using encryption and a secure server. We cannot be held responsible for the web sites that Packyourbags.com may link to or the validity of the information that they provide. We endeavour to use only useful links that are in no way profit making to ourselves by your interaction with such sites.
Delivery of goods shall be agreed at the point of purchase. If we cannot deliver the goods within the agreed time we shall inform the customer immediately and with their agreement, arrange another time for delivery. If we cannot agree on another time for delivery we will offer the client a refund.
Client is the person named on the specification sheet for whom the supplier has agreed to provide the specified service in accordance with these conditions.
Tour operator and consolidator shall mean the tour operator and consolidator who the booking has been placed with and Packyourbags.com acts as an agent for.
Contract means the contract for the provision of the specified service.
Document includes, in addition to a document in writing, any plan, graph, drawing or photograph or other device embodying visual images and any disc, tape or other device embodying any other data.
Input material means any document or other materials, and any data or other information provided by the client in respect of any contract we enter or propose entering into with the client
Output material means any document or other materials, and any data or other information provided by the supplier relating to the specified service.
Specification sheet means the sheet to which these conditions are appended.
Specified service means the service to be provided by the supplier for the client and referred to in the schedule hereto and to include information on full and consolidated fares and bookability on the Web.
Supplier means CTT Group Ltd. 33 Mount Pleasant Road, Tunbridge Wells, Kent. TN1 1PN
The supplier shall provide the specified service to the client subject to these conditions and the booking conditions of the tour operator and or consolidator. All booking conditions are subject to common law. All Tour Operator terms and conditions will apply.
The client shall at its own expense supply the supplier with all necessary documents or other materials, and all necessary data or other information relating to the specified service, within sufficient time to enable the supplier to provide the specified service in accordance with the contract. The client shall ensure the accuracy of all input material.
The client shall at its own expense retain duplicate copies of all input material and insure against its accidental loss or damage. The Supplier shall have no liability for any such loss or damage, however caused. All output material shall be at the sole risk of the client from the time of delivery to or to the order of the client.
The specified service shall be provided in accordance with the specification sheet and otherwise in accordance with the supplier's current brochure or other published literature relating to the specified service from time to time, subject to these conditions.

The Supplier may correct any typographical or other errors or omissions in any brochure, promotional literature, quotation or other document relating to the provision of the Specified Service without any liability to the Client.
The Supplier may at any time without notifying the Client make any changes to the Specified Service which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Specified Service.
Rights in Input Material and Output Material
The property and any copyright or other intellectual property rights in:
(a) any Input Material shall belong to the Client, and
(b) any Output Material shall, unless otherwise agreed in writing between the Client and the Supplier, belong to the Supplier, subject only to the right of the Client to use the Output Material for the purposes of utilising the Specified Service.
Any Input Material or other information provided by the Client which is so designated by the Client and any Output Material shall be kept confidential by the Supplier, and all Output Material or other information provided by the Supplier which is so designated by the Supplier shall be kept confidential by the Client; but the foregoing shall not apply to any Documents or other materials. data or other information which are public knowledge at the time when they are so provided by either party, and shall cease to apply if at any future time they become public knowledge through no fault of the other party.
The Client warrants that any Input Material and its use by the Supplier for the purpose of providing the Specified Service will not infringe the copyright or other rights of any third party, and the Client shall indemnify the Supplier against any loss, damages, costs, expenses or other claims arising from any such infringement.
Subject to paragraph the Supplier warrants that any Output Material and its use by the Client for the purposes of utilising the Specified Service will not infringe the copyright or other rights of any third party, and the Supplier shall indemnify the Client against any loss, damages, costs, expenses or other claims arising from any such infringement.
Brochure content is supplied by a third party.
Warranties and Liability
The Supplier does not give any warranty or representation whatsoever in connection with the accuracy and/or completeness of any information provided pursuant to the Specified Service. Where the Supplier supplies in connection with the provision of the Specified Service any goods or services (including Output Material) supplied by a third party (including, without limitation, the suppliers), the Supplier does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Client the benefit of any warranty, guarantee or indemnity given by the person supplying the goods or services to the Supplier.The Supplier shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any Input Material or instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.
Except in respect of death or personal injury caused by the Supplier's negligence, the Supplier shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss which could not reasonably have been within the contemplation of the parties, damage, costs, expenses or other claims (whether caused by the negligence of the Supplier, its servants or agents or otherwise) which arise out of or in connection with the provision of the Specified Service or their use by the Client, and the entire liability of the commission received by the Supplier from the consolidators for the Client's booking.
The Supplier shall not be liable to the Client or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Supplier's obligations in relation to the Specified Service, if the delay or failure was due to any act of God, fire, flood, draught or other abnormal weather conditions, war, strike, lock-out or other industrial dispute, civil commotion, riot, malicious damage, breakdown of plant or machinery, default of suppliers, (including, without limitation, any action or omission by any consolidator and/or airline).
Changes or amendments
Where administration changes to a booking are made we will charge £25 per change.
Once a holiday, hotel or flight booking is completed on or offline a contract is entered into with the supplier by Packyourbags.com on behalf of the client and any cancellation fees or charges made by the supplier shall be applied to the booking and the cost shall be met by the client. Packyourbags.com may levy its own administration fees as laid out in these terms and conditions and apply them to the booking as well. All flight only tickets are non-refundable and non-exchangeable.
Termination, payments and deposits
Any booking made by the Client shall be a contract made between the Client and the suppliers and cannot be cancelled by the Client unless otherwise agreed in writing by the suppliers. Save as provided above either party shall be entitled to terminate the Contract at any time. We will charge a £25 administration fee for terminating the contract or amending any details of the contract.
Where we are offering a 20% deposit scheme, in the event you cancel your booking you will be liable to pay the full cancellation charges made by the tour operator who supplied the holiday, plus any administration fees that may arise from Packyourbags.com cancelling the holiday on your behalf. The 20% deposit is valid on certain holidays where indicated and gives you the customer the opportunity to secure a booking using a small deposit. If you choose this option you enter into a contract with Packyourbags.com; you will have booked the holiday and will be required to pay the full amount of the holiday at the specified time or be liable for any cancellation charges applied by the tour operator in the event you wish to cancel.
Where a credit card has been used to make a booking the balance due will be, in accordance with the terms of the booking, automatically debited from the card 12 weeks prior to departure or in the event of a cancellation. If payment is not received 12 weeks prior to departure then Packyourbags.com reserves the right to cancel the booking and charge the customer any outstanding deposit or cancellation fees applied by the tour operator.
General
All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to the other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.
No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
If any dispute arises under or in connection with these Conditions or the provision of the Specified Service without prejudice to the right of the Supplier or the Client to bring legal proceedings the Supplier and the Client may in the first instance attempt to settle it by negotiation and if negotiations fail, then the dispute may be submitted to mediation by CEDR (the Centre for Dispute Resolution) within 14 days of one party giving written notice to the other of the intention to refer it to mediation by CEDR.
English law shall apply to the Contract, and the parties agree to submit to the non-exclusive jurisdiction of the English courts.
